Terms and Conditions of Use — SapiensPashu™ Platform

These Terms and Conditions ("Terms") govern the access to and use of the SapiensPashu™ Platform, including its mobile applications, websites, dashboards, portals, APIs, software systems, AI engines, blockchain systems, and related services (collectively referred to as the "Platform").
The Platform is owned, operated, and managed by SapiensVet Pvt. Ltd., and branded as SapiensPashu™.
SapiensPashu™ is an AI-powered digital livestock ecosystem that facilitates livestock biometric identification, digital health management, welfare management, insurance enablement, government scheme transparency, and related stakeholder services.
By accessing, registering, or using the Platform, you agree to comply with these Terms.
If you do not agree, you must not use the Platform.

Users agree to:
Users remain solely responsible for their submitted information.
Registration of a pashu on the Platform does not create legal ownership, custody, guardianship, transfer of rights, or legal liability. The Platform merely acts as a system of record.
Biometric identification is an assistive technology. Accuracy may vary due to:
Absolute identification accuracy cannot be guaranteed. The Platform shall not be liable for identification errors.
AI-generated outputs, including alerts, recommendations, productivity estimates, risk scores, predictions, and insights, are informational and assistive only. They do not constitute:
Final decisions always remain with authorized professionals.
SapiensPashu does not practice veterinary medicine. The Platform shall not be liable for diagnosis, treatments, prescriptions, clinical decisions, or veterinary medical outcomes. Users must consult licensed veterinarians.
Milk-related analytics including milk quantity, fat %, SNF %, revenue estimates, and productivity indicators are dependent upon user-entered data.
SapiensPashu does not guarantee milk yield, income generation, or farm profitability.
SapiensPashu does not underwrite policies, approve/reject policies, set premiums, or settle claims. All insurance decisions remain solely with insurers.
The Platform only facilitates animal verification, beneficiary support, and record management. The Platform does not approve subsidies, sanction benefits, or guarantee eligibility. Final decisions remain with government authorities.
Blockchain provides traceability, tamper-evidence, and transparency. Blockchain does not independently validate the truthfulness or legality of underlying information.

The Platform shall process personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable Indian laws.

Users retain ownership of uploaded content. Users grant SapiensPashu a limited, non-exclusive, royalty-free license to process such content solely for operating and improving the Platform.
Users shall not:
Users shall not scrape data, penetration test, attack servers, introduce malware, or circumvent security mechanisms. Violations may result in immediate account termination and legal action under the Information Technology Act, 2000 and the DPDP Act, 2023.
The following remain the exclusive property of SapiensVet Pvt. Ltd.:
Logos, software systems, databases, algorithms, interfaces, and visual assets are protected under Indian copyright and trademark laws.
The Platform is provided on an "as available" basis. Uninterrupted availability or zero latency is not guaranteed.
Accounts may be suspended or terminated for fraud, data misuse, compliance violations, legal directives, or cybersecurity threats.
To the maximum extent permitted by law, SapiensVet Pvt. Ltd. shall not be liable for data inaccuracies, AI errors, veterinary medical outcomes, insurance underwriting decisions, scheme approvals, or indirect damages.
The aggregate liability shall not exceed the amount paid by the user during the preceding 12 months, if any.
Users agree to indemnify and hold harmless SapiensVet Pvt. Ltd. from claims arising from misuse, fraud, violation of laws, or unauthorized activities.
SapiensPashu shall not be liable for events beyond reasonable control, including natural disasters, disease outbreaks, epidemics, internet failures, cloud provider outages, or regulatory actions.
These Terms shall be governed by and construed in accordance with the laws of India.
Disputes shall first be resolved through good-faith negotiations. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.
The seat of arbitration and exclusive jurisdiction shall be:
SapiensPashu reserves the right to modify these Terms at any time. Continued use of the platform constitutes acceptance of the revised Terms.
